Terms of Service

These Terms constitute a legally binding agreement between you (“User”, “you”) and HypeShip (“Company”, “we”, “us”). By creating an account or using any part of the HypeShip service, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into this agreement.

We reserve the right to update these Terms at any time. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.

HypeShip is a software-as-a-service (SaaS) platform that connects to your GitHub account, reads your commit and pull request activity, and uses artificial intelligence to generate draft social media posts. You may review, edit, approve, and publish those drafts to connected social media accounts (currently Twitter/X).

We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice. We will make reasonable efforts to provide advance notice of significant changes.

You are responsible for maintaining the security of your account credentials. Notify us immediately at hello@hypeship.site if you suspect unauthorized access to your account.

• You must provide accurate and complete information when creating your account.
• You may not share your account or allow others to access it on your behalf without our written consent.
• One person or legal entity may not maintain more than one free account.
• You are responsible for all activity that occurs under your account.

You agree not to use HypeShip to:

• Publish content that is unlawful, defamatory, harassing, obscene, fraudulent, or otherwise objectionable
• Violate the terms of service of any connected platform (GitHub, Twitter/X)
• Attempt to gain unauthorized access to any part of the service or its infrastructure
• Use the service to generate spam or bulk unsolicited content
• Reverse-engineer, decompile, or disassemble any part of the service
• Resell or sublicense access to the service without our prior written consent
• Use the service in any way that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these guidelines, with or without notice.

Your content. You retain ownership of your GitHub repository data and any edits you make to AI-generated drafts. By using HypeShip, you grant us a limited license to access, process, and display your content solely for the purpose of providing the service.

AI-generated content. Post drafts generated by HypeShip’s AI are provided as suggestions. You are responsible for reviewing and approving all content before publication. We do not warrant that generated content is accurate, appropriate, or free from errors.

HypeShip IP. The HypeShip name, logo, software, and service are owned by us and protected by intellectual property laws. Nothing in these Terms transfers ownership of HypeShip IP to you.

Paid plans are billed monthly or annually in advance. All fees are in USD and are non-refundable except as required by law or at our sole discretion.

• You authorize us to charge your payment method on a recurring basis for the selected plan.
• If a payment fails, we will notify you and may suspend your account until payment is resolved.
• Plan upgrades take effect immediately; downgrades take effect at the start of the next billing period.
• We reserve the right to change pricing with at least 30 days’ advance notice.

By you. You may cancel your subscription at any time from your account settings. Your access to paid features will continue until the end of the current billing period, after which your account will revert to the free Starter plan.

By us. We may suspend or terminate your account at any time if you violate these Terms, if we suspect fraudulent activity, or if we discontinue the service. In the event of termination without cause, we will provide a prorated refund for any unused paid period.

Upon termination, your right to use the service ceases immediately. We will retain your data for 30 days following termination before permanent deletion, during which time you may export your data.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYPESHIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM:

• Your use of or inability to use the service
• Any content published through the service
• Unauthorized access to or alteration of your data
• Any actions or conduct of third parties on the service

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

You agree to indemnify, defend, and hold harmless HypeShip and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
